Client Data shall remain the property of Client. On the Client's website ClickIQ may track, store and/or report user activities for the Client. Such data will typically be impressions, interactions (applies, registrations) and clicks and similar data related to user activities on the Client's website.
Certain trademarks, trade names, service marks and logos, icons and domain names used or displayed on the Site or via the Services are registered and unregistered trademarks, trade names and service marks owned by ClickIQ and/or our affiliates. Other trademarks, trade names and service marks used or displayed on the Site are the registered and unregistered trademarks, trade names and service marks owned by their respective owners and used with permission by us. Nothing grants or should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademarks, trade names, service marks or logos displayed on the Site or via the Services without our written permission or the written permission of such third-party owner.
You have and shall retain ownership of your User Communications. You declare and warrant to us that you are entitled to transmit, use or post User Communications and have all relevant licenses and consents from any relevant third parties. Further, we and our affiliates are free to use any ideas, concepts, know-how or techniques contained in any User Communication you send via the Site or Service for developing, marketing and providing products and services. You further acknowledge and agree that we own all of the information we collect from job applicants, including information collected via cookies and web beacons regarding job ad views, job application starts and job application completions. Further, in no event will we publicly disclose any performance-related data specific to you.
You expressly agree that use of the site and services is at your sole risk. ClickIQ does not evaluate, screen or censor the applications submitted in connection with the services or the applicants themselves. ClickIQ is not involved in and does not control the transaction between a job applicant and you. Accordingly, ClickIQ is not responsible for your interaction with any person who contacts you, including job applicants, in connection with your use of the services or the site. The site and services are provided on an “as is” and “as available” basis. We expressly disclaim all warranties of any kind, express or implied, with respect to the site and services available at the site, including without limitation any warranty of merchantability, fitness for a particular purpose or non-infringement.
We make no warranty that the site or services will meet your requirements, or that the site or services will be uninterrupted, timely, secure, current, accurate, complete or error free. The warranty disclaimers set forth in this section do not apply to the extent prohibited by law. Please refer to your local laws for any such prohibitions.
In no event will we be liable for any indirect consequential, incidental, punitive, special or similar damages (or damages from lost profits, interruption of business, lost data), whether forseeable or not, which may arise out of your access to, inability to access, or your use of, the site or services provided herein or resulting from unauthorised access to or alteration of your user communications.
Notwithstanding anything herein to the contrary, our sole liability for any reason to you, and your sole and exclusive remedy for any cause or claim whatsoever, shall be limited to the amount paid by you for the services during the three month period prior to any claim.

ClickIQ contains links to external sites. ClickIQ is not responsible for and has no control over the content of such sites. Information on ClickIQ, or available via hypertext link from ClickIQ, is made available without responsibility on the part of ClickIQ. ClickIQ disclaims all responsibility and liability (including for negligence) in relation to information on or accessible from ClickIQ.
When you register as a user of the Service and at other times, you submit basic information such as your company name, email address, phone number and physical address. We also collect and maintain your user ID and password, which you create and provide to use. In connection with using the Service, from time to time, you will provide us with job openings and data regarding candidate sources, such as the source of impressions, applications and registrations. This information will be made available by the Client using a cookie or tag on the Client site.
Most web browsers automatically accept cookies, but browser settings can be changed to prevent these cookies from collecting information. Disabling cookies does not necessarily disable the use of pixel tags, web beacons and other technologies that collect information.
We use the information you provide to us and the information we collect from job applicants for the following purposes:
You acknowledge and agree that we own all of the information we collect from job applicants, including information collected via cookies and web beacons regarding job ad views, job application starts and job application completions. We may use such information for any purpose whatsoever in connection with our business; provided, however, that we will not sell such information to data brokers or any other third parties. Further, in no event will we publicly disclose any performance-related data specific to you.
We will disclose the information we collect if we reasonably believe we are required to do so by law, regulation or other government authority. We may also cooperate with law enforcement agencies in any official investigation and we may disclose information to the relevant agency in doing so.
We reserve the right to share information in connection with any corporate transaction, including any merger, consolidation, restructuring, the sale of stock and/or assets, or other corporate change or financing transaction including, whether during the course of any due diligence process or otherwise.

Please do not disclose your user IDs or passwords to unauthorised people. We use reasonable efforts to keep your information safe. Although we take reasonable precautions to protect your information, no website or Internet transmission is completely secure, and we cannot guarantee that unauthorised access, hacking, data loss, or other breaches will never occur.
You are responsible for providing privacy notices to your job applicants, including notice that we are collecting certain information as described herein and any other notices required by applicable law.
